U.S. LNG Exports: DOE and FERC Roles and Boundaries

The Biden Administration’s January decision to pause authorizations to export liquefied natural gas (“LNG”), as discussed here, raises several potential “post pause” legal issues that could emerge under a Democratic or Republican Administration.

VNF Partner Kyle Danish has coauthored a Center for Strategic International Studies Commentary that outlines the existing legal framework under the Natural Gas Act for LNG exports, explores the responsibilities of DOE and FERC in evaluating proposed LNG export projects, and discusses what might change after the "pause" given these constraints.
