Kyle Danish was quoted in Megawatt Daily on a California court's ruling to halt implementation of a low carbon dioxide fuel standard because it violated the Constitution's Commerce Clause.  Mr. Danish acknowledged that the ruling may strengthen the resolve of potential litigants making similar complaints against California, but added, "the Commerce Clause issue has loomed over California's cap-and-trade program since the early days."
