Waters of the US Coalition

The firm represents a broad coalition of public and private corporations to facilitate the coalition’s response to the April 21, 2014 Notice of Proposed Rulemaking by the U.S. Environmental Protection Agency and U.S. Army Corps of Engineers redefining “waters of the United States” under the Clean Water Act (CWA).  The proposed rule would greatly expand the agencies’ jurisdiction over streams, wetlands and other water bodies, with significant impacts on project development and operations across the energy, water, construction, building, agricultural and transportation sectors.  Attorneys at the firm have undertaken substantive analysis of the proposed rule and its implications for project and infrastructure development, maintenance, enforcement, and are providing in-depth review of the scientific study prepared by EPA in support of the rule.  The firm is working closely with coalition members to prepare detailed comments on, and recommended revisions to, the draft rulemaking to be submitted prior to the comment deadline.
