Cape Hatteras Access Preservation Alliance

Van Ness Feldman represents the Cape Hatteras Access Preservation Alliance (CHAPA) in litigation challenging the National Park Service’s (NPS) management of off-road vehicle (ORV) and other public access to, and use of, the beaches at Cape Hatteras National Seashore Recreation Area (CHNSRA).  The NPS issued a final plan significantly restricting ORV and other access and use of the beaches at CHNSRA in December 2010, pursuant to a consent decree ordered in response to a lawsuit by several environmental groups.  Van Ness Feldman represented CHAPA in the planning and rulemaking process and in litigation brought by the organization in federal district court under the Administrative Procedure Act (APA), National Environmental Policy Act (NEPA), and other statutes.
