Emissions Permitting & Emission Reduction Purchase Agreements

Obtaining a Clean Air Act Prevention of Significant Deterioration permit for greenhouse gas emissions.  For a multinational chemicals company, Van Ness Feldman is serving as environmental permitting counsel for development of a chemicals manufacturing plant. The firm is assisting the company with a needed Clean Air Act Prevention of Significant Deterioration permit for the plant’s greenhouse gas emissions, as well as other needed environmental permits.

Ensuring end-use energy efficiency is a compliance option under Clean Air Act 111(d) regulations.  Van Ness Feldman has been retained by a coalition of six multinational companies that manufacture energy efficient equipment and provide energy efficiency services to provide legal counsel related to the Environmental Protection Agency’s section 111(d) greenhouse gas emission regulations for existing power plants. The firm has assisted the coalition in developing and presenting to the EPA a detailed policy proposal for ensuring that states can use end-use energy efficiency measures in their section 111(d) compliance plans for regulated power plants.

Providing legal counsel on an emissions trading agreement for a coal mine methane project.  Van Ness Feldman advised a developer of a coal mine methane offset project on drafting and executing an Emission Reduction Purchase Agreement under which the developer was selling early action California offset credits to an energy company buyer.
