This past Saturday, the Environmental Protection Agency missed its deadline to finalize its new source performance standard (NSPS) which would limit carbon dioxide emissions to 1,000 pounds per megawatt-hour at all new power plants.
Van Ness Feldman attorney, Kyle Danish, was quoted in Greenwire on the issue, stating, "EPA has a strong interest in ensuring that its new source NSPS is as legally fortified as possible, because the agency needs that rule to survive the challenge in order to move forward with the much more influential rule for existing power plants."
