Iron Mountain

Van Ness Feldman represents Iron Mountain with significant mining operations in Washington State. The firm has provided due diligence evaluations for new mine acquisitions, led the land use and environmental entitlement process for new and expanded operations, and obtained permit renewals for existing mines. Most recently the firm worked on a significant expansion of hard rock quarry operations in Jefferson County. This work initially involved successfully litigating the client’s right to engage in expanded mining operations without the need for a Comprehensive Plan amendment or a conditional use permit under Washington’s diminishing assets doctrine related to nonconforming mineral uses. Thereafter Van Ness Feldman led a consultant team to prepare detailed engineering and scientific studies over a three year process to successfully demonstrate to the County and respond to community activists that the project could be built without adverse impacts.
