Missouri River Energy Services

The firm serves as licensing and regulatory counsel to Missouri River Energy Services (MRES) for matters pertaining to the construction and operation of the new Red Rock Hydroelectric Project, to be located at a U.S. Army Corps of Engineers Dam (Corps) on the Iowa River. Matters on which the firm has advised MRES include development of plans to implement environmental requirements, strategies for obtaining approval of substantial pre-construction amendments to the licensed facilities, negotiation of a site access agreement with the Corps, and negotiation of water quality certification with the state water quality agency. The firm also conducted due diligence on behalf of MRES regarding acquisition of the project license. In addition, the firm has advised MRES with regard to several competing preliminary permit applications.
