Van Ness Feldman served as co-lead appellate counsel in the U.S. Court of Appeals for the D.C. Circuit in a challenge by several petitioner trade associations to EPA’s “E15” waiver (which permitted U.S. refiners to blend up to 15% ethanol in gasoline to satisfy the required annual amount of renewable fuels the refiners must use). A VNF member also served as lead appellate counsel in the D. C. Circuit for the Licensee (Louisiana Energy Services) in a challenge to the Nuclear Regulatory Commission’s license for a new uranium enrichment facility in New Mexico. VNF is now lead counsel in the D.C. Circuit for the Gas Processors Association in challenges to EPA’s NSPS Subpart OOOO regulations applicable to oil and gas tanks.
