Van Ness Feldman Attorneys Score Win for Clients at DC Circuit Court of Appeals

Today, the United States Court of Appeals for the District of Columbia Circuit issued a judgment in favor of firm clients, Tennessee Gas Pipeline Company and Project Canary, in consolidated cases challenging actions by the Federal Energy Regulatory Commission (FERC) denying objections to a new pooling service for responsibly sourced gas (RSG) by the Tennessee Gas Pipeline Company. The petitioners, gas producers which use Tennessee’s services, in challenging FERC’s decisions, claimed harm due to unsupervised environmental standards set by Tennessee.

With the assistance from Michael Diamond, who drafted the brief for both firm clients, Paul Korman, who made a compelling argument in support of FERC, and invaluable guidance from Mike McBride, the firm successfully secured dismissal of the petitions for review, with the Court finding that the petitioners failed to establish standing.
