Mike McBride comments on the difficulties facing nuclear plant operators adding to on-site inventories and the failure of the Department of Energy to accept spent fuel.  Mr. McBride states in written testimony that as of June, 72 cases had been filed against the government in federal courts over the department's failure to meet used-fuel obligations under the revised National Waste Policy Act of 1982.  He added that $760 million has already been paid to the Tennessee Valley Authority following a trial court judgement that was not appealed and that eventually the DOE could face $13.1 billion in liabilities if it begins to accept used fuel in 2021.
