David Yaffe provides regulatory, contract, business and dispute resolution counseling to participants in the market-oriented electric utility and natural gas industries. He has particular experience in addressing the unique needs of, and challenges facing, public agencies.
His experience includes:
- Creation of, and operations within, independent system operator (ISO) and regional transmission operator (RTO) regimes;
- Negotiation and subsequent regulatory administration of merchant transmission projects;
- Representation in Federal Energy Regulatory Commission (FERC) transmission policy, electric and natural gas rate and certificate matters, rulemakings, etc.;
- Power sale contracts;
- Joint venture electric generating facility arrangements;
- Complex interconnected operations arrangements; and
- Arbitration, mediation, and litigation of electric power arrangements.
Mr. Yaffe also appears before state public utility commissions on rate, renewable resource, and other issues. He counsels a variety of clients – including wind developers and joint-action agencies – in the negotiation of power purchase interconnection and transmission contracts and related issues involving wind facilities.
In addition, Mr. Yaffe represents clients in cooperative and adversarial relationships with the federal government’s power marketing agencies. He is a frequent speaker on a wide range of energy issues and has published numerous articles in that area.
Mr. Yaffe was an exchange student in The Netherlands from 1969 to 1970, and he speaks conversational Dutch.
