Malcolm McLellan’s practice focuses on electric utility regulation, commercial law, commercial fisheries regulation, and non-profit corporate law.  Mr. McLellan's expertise also extends to litigation, municipal law, public utility district law, corporate law, municipal bond offerings, and environmental law related to the protection of endangered species.   

With respect to electric transmission issues, Mr. McLellan is involved with matters including:  compliance with Federal Energy Regulatory Commission policies, regulations and orders; the use of electric transmission rights; the implementation of the pro forma Open Access Transmission Tariff and related business practices; and the construction of new transmission facilities.  In response to Federal Energy Regulatory Commission regulations, Mr. McLellan was intimately involved with the Northwest electric utilities’ various efforts to reform the management of high-voltage electric transmission operations. 

As part of his practice in commercial fisheries regulation, Mr. McLellan is actively involved with the seafood processing sector’s implementation of the National Marine Fisheries Service’s Bering Sea and Aleutian Islands Crab Rationalization regulations.

Mr. McLellan also has accumulated a significant amount of experience working with, forming, and dissolving non-profit corporations, cooperatives, and various other business ventures.  

In all areas of his practice, Mr. McLellan offers clients a unique ability to successfully negotiate complex, multi-party agreements.  Examples of these include agreements that:

  • Allow electric balancing areas to reduce generation movements when responding to area control errors.
  • Mitigate the impact of hydroelectric generating facilities on salmon and steelhead.
  • Address the formation of the Pacific Northwest Security Coordinator.
  • Relate to the Pacific Northwest Coordination Agreement; including the Mid-Columbia Hourly Coordination Agreement.
  • Implement the Canadian treaty for storage of water on the Columbia River.
  • Relate to the Western Electric Coordination Council’s Reliability Management System.
