Infrastructure Security
Print PDFVan Ness Feldman's infrastructure security practice addresses emerging issues affecting the energy, water, chemical, and transportation sectors. In particular, our professionals develop effective and creative solutions to funding, compliance, and implementation issues arising from the preservation and protection of critical assets. We also facilitate client management of security-related impacts on commercial business practices.
To achieve these objectives, our professionals ensure effective client participation in the policymaking process, provide counsel regarding regulatory compliance obligations, and assist client initiatives to secure funding for security-related requirements. Additionally, Van Ness Feldman works extensively with the federal government to ensure that the policies and regulations that govern critical assets are practical, effective, and cost-efficient.
Specifically, Van Ness Feldman works with clients to:
- Assess applicable security-related laws, regulations, and international agreements to identify requirements and develop compliance strategies.
- Analyze relevant voluntary guidance documents and regulations, such as the Department of Homeland Security's National Infrastructure Protection Plan (NIPP) or its Protected Critical Infrastructure Information (PCII) Program, to evaluate government expectations and private sector responsibilities.
- Conduct corporate due diligence.
- Prepare vulnerability and risk assessments.
- Create disaster/emergency management and business continuity plans.
- Protect confidential business information.
- Comply with NERC applicable standards.
- Review and critique management systems and ongoing compliance strategies.
- Identify and provide input into legislative and regulatory initiatives.
- Obtain security-related benefits, such as certification under the Support Anti-terrorism by Fostering Effective Technologies Act (SAFETY Act).
