EPA Issues Advance Notice of Proposed Rulemaking on Greenhouse Gas Regulation

The Environmental Protection Agency (EPA) issued an Advance Notice of Proposed Rulemaking (ANPR) requesting public comment on whether and how the Agency should regulate emissions of greenhouse gases using its authority under the Clean Air Act. While further EPA action on this subject during the current presidential administration appears quite unlikely absent specific direction from Congress or the judiciary, the request for public comment on the ANPR is an important opportunity for entities that could be affected by future GHG regulations to provide input to the regulatory process.

EPA Proposes to Lower the 8-Hour Ozone Standard

On June 21, EPA announced its proposal to revise the 8-hour ozone National Ambient Air Quality Standard (NAAQS) to within the range of 0.070 to 0.075 parts per million (ppm).

The U.S. Environmental Protection Agency (EPA) signed a final rule to revise the National Ambient Air Quality Standards for Particulate Matter, requiring that the Administrator of the EPA complete a thorough review of the NAAQS at 5 year intervals, and based on this review, make such revisions to the NAAQS as may be appropriate to provide requisite protection of public health welfare.

California Legislature Approves Statewide Cap on Greenhouse Gas Emissions

On August 31, the California Assembly approved a bill establishing a cap on statewide emissions of greenhouse gases. A.B. 32, the “Global Warming Solutions Act,” will cap emissions at 1990 levels by 2020 – the equivalent of a 20-25% reduction. The bill vests broad authority in the state Air Resources Board to develop and enforce regulations to meet the cap; the regulations must be in effect beginning in 2012.
