Rockies Express Pipeline

Our firm brought its interdisciplinary experience to bear on all aspects of this complex pipeline project that will bring natural gas drilled in the Rocky Mountain region to markets in the Midwest and Eastern United States.  We handled environmental permitting, FERC tariff regulation, relationships with state and local governments, and negotiations with consumers of capacity on the pipeline.  The third segment of the pipeline alone crosses over 1,485 surface water bodies, including the Mississippi River, and the habitats of 10 federally listed threatened or endangered species, and 3 candidate species, calling upon our firm’s depth of legal expertise with such large scale energy infrastructure projects.

The Rockies Express-East pipeline will transport more than 1.8 billion cubic feet of gas per day. The 639 mile (1,028-km) pipeline will connect with the eastern end of the REX-West pipeline in Missouri, stretch through Illinois and Indiana, and terminate at a connection with three other pipelines in Ohio.

The Western segment of the pipeline was one of the first major projects to negotiate the FERC’s pre-filing procedures adopted as part of the Energy Policy Act of 2005.  Portions of the pipeline went into service in early 2007, with the balance scheduled to enter service in 2008.
