Van Ness Feldman's recent Alert entitled "Ninth Circuit Holds FERC’s Market-Based Rate Program Valid Under the Federal Power Act," was quoted in The Energy Daily.   The article examines the Court's ruling that FERC is able to determine that markets will produce fair prices, and that the Federal Power Act does not demand that FERC evaluates individual changes in market-based rate programs.
